1. WHO WE ARE
Palm Sudoku 1985 is published by Curry & Co. In these Terms, “Palm Sudoku,” “we,” “us,” and “our” refer to Curry & Co., and “you” refers to the person using the Services.

2. ACCEPTING THESE TERMS
By downloading, installing, purchasing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be legally able to enter into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you.
3. LIMITED LICENSE
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules, solely for personal, non-commercial entertainment.
The Services are licensed, not sold. We and our licensors retain all right, title, and interest in the Services, including the software, puzzles, artwork, characters, interface, text, sounds, trademarks, and other content, except for third-party content identified in the Services.
4. GAMEPLAY AND ACCESS
Palm Sudoku 1985 currently offers three puzzle difficulties: Wimpy, Hefty, and Thrasher. The app may offer one fresh game per calendar day without Pro access. Pro access unlocks additional or unlimited fresh games while the applicable entitlement remains active. Exact features may change as the app evolves.
Puzzles are generated for entertainment. We do not guarantee that a particular puzzle, score, timer, hint, saved game, difficulty, or other gameplay state will always be available or recoverable. Deleting the app, changing devices, clearing device storage, or a software error may remove locally stored game data.
5. PURCHASES, PRO ACCESS, AND BILLING
If the app offers a paid product or auto-renewing subscription, its price, billing period, included features, and any trial terms will be shown in the purchase screen before you confirm. Purchases are processed by Apple through your Apple Account; we do not receive or store your full payment-card details.
- Payment is charged to your Apple Account when you confirm the purchase.
- An auto-renewing subscription renews unless canceled at least 24 hours before the end of the current period. Apple may charge your account for renewal within 24 hours before that period ends.
- You can manage or cancel an Apple subscription in your device's subscription settings. Deleting the app does not cancel a subscription.
- The app includes a restore-purchases function for eligible purchases associated with your Apple Account.
- Refund requests and billing disputes are handled by Apple under Apple's policies and applicable law. You can start at reportaproblem.apple.com.
Prices may vary by country, currency, taxes, and App Store rules. We may change future prices or offerings, but any subscription price change will be handled as required by Apple and applicable law. Nothing in these Terms limits rights that cannot legally be waived.
6. JAMS AND THIRD-PARTY AUDIO
The optional Jams feature connects to live audio streams provided by 181.fm. Stream availability, programming, audio quality, and content are controlled by that provider and may change or stop without notice. Music and station content belong to their respective owners.
Streaming uses data and may result in carrier charges. You are responsible for your network connection and any related fees. Your use of third-party streams may also be subject to the provider's own terms and privacy practices.
7. ACCEPTABLE USE
You may not:
- copy, distribute, sell, lease, sublicense, or commercially exploit the Services except where applicable law expressly permits it;
- reverse engineer, decompile, disassemble, or attempt to extract source code, except to the limited extent that law prohibits this restriction;
- bypass purchase controls, security measures, access limits, or technical restrictions;
- interfere with the Services, introduce malicious code, overload infrastructure, or use automated means to access the Services in a harmful manner;
- remove proprietary notices or use our branding in a way that suggests endorsement, affiliation, or ownership; or
- use the Services for unlawful, fraudulent, or abusive activity.
8. FEEDBACK
If you send ideas, suggestions, or other feedback, you give us permission to use it without restriction or compensation to you. This does not transfer ownership of personal information included in your message; our Privacy Policy still applies to that information.
9. THIRD-PARTY SERVICES
The Services rely on or may link to third parties, including Apple, RevenueCat, 181.fm, Cloudflare, and external websites. We do not control those services and are not responsible for their content, availability, security, terms, or privacy practices. Links are provided for convenience and do not imply endorsement.
10. UPDATES AND AVAILABILITY
We may add, remove, suspend, or change features; release updates; or stop supporting part or all of the Services. Updates may be required for continued use. We do not promise that the Services will be uninterrupted, error-free, compatible with every device or operating system, or available in every location.
11. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE SECURE, AVAILABLE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURRY & CO. AND ITS OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, SAVED GAMES, PROFITS, REVENUE, GOODWILL, OR USE; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH LOSS IS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE APP STORE FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$50.
These limits do not apply where prohibited, including to liability that cannot be limited under applicable consumer law.
13. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Curry & Co. and its owners, affiliates, and representatives from third-party claims and reasonable costs arising from your unlawful use of the Services or material violation of these Terms. This obligation does not apply to the extent a claim results from our own conduct.
14. SUSPENSION AND TERMINATION
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or use the Services unlawfully. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.
15. APPLE-SPECIFIC TERMS
These Terms are between you and Curry & Co., not Apple. Curry & Co., not Apple, is responsible for the app and its content, maintenance, support, and claims concerning the app, subject to these Terms. Apple has no obligation to provide maintenance or support.
If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its policies and law. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.
You represent that you are not located in a country subject to a U.S. government embargo or designated as supporting terrorism, and that you are not listed on a U.S. government prohibited or restricted party list.
16. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of the jurisdiction in which Curry & Co. is established, without regard to conflict-of-law principles. Courts with jurisdiction over Curry & Co. will have non-exclusive jurisdiction over disputes, except where applicable law gives you the right to bring a claim elsewhere.
If you are a consumer, mandatory protections in your home jurisdiction remain in effect. Nothing in these Terms limits rights or remedies that cannot be limited by contract.
17. GENERAL TERMS
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services, except for additional terms shown at purchase or required by an app store. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or sale of the Services.
18. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the updated version here and change the effective date. If a change is material, we will provide additional notice where required. Continued use after updated Terms take effect means you accept them.
